Terms of Service
These Terms and Conditions apply to all sales of products and provision of services by Haze Media Pty Ltd trading as Academic Media (ABN 29 109 140 089) ('Academic Media') to any customer ('the Customer').
Title to Products
Ownership of all products remains with Academic Media until the full purchase price and any other amounts owing have been paid in full. Until then:
- Products remain the property of Academic Media, even after delivery and transfer of risk to the Customer
- Academic Media may recover products from the Customer's premises and resell them if any payment is overdue
- The Customer holds products in a fiduciary capacity on behalf of Academic Media
- The Customer may sell products in the ordinary course of business and pass good title to bona fide purchasers; any sale proceeds are held in trust for Academic Media until payment is received in full
Liability
The Customer is responsible for ensuring that all products and services ordered are suitable and sufficient for their intended purpose. Academic Media is not liable for any indirect, consequential, or incidental loss arising from the use of our products or services, except as required under the Australian Consumer Law.
Delivery
Academic Media delivers products using our own drivers and third-party transport partners, depending on your location. Delivery costs are calculated based on product size, weight, and delivery address, and are displayed in the shopping cart prior to checkout.
Academic Media is not liable for delays in delivery caused by third-party carriers or circumstances beyond our control. We reserve the right to apply delivery charges.
Payment
Approved direct debit customers are required to make payment within 14 days of invoice date. Interest at 0.8% per calendar month (or part thereof) will apply to overdue amounts.
Credit and debit card payments made online attract a processing fee of 1.75%.
Recovery of Legal Costs
If payment is not received by the due date, Academic Media reserves the right to suspend delivery of goods or services and commence collection action. The Customer will be responsible for all associated costs, including legal fees on a solicitor/client basis, court fees, collection expenses, and any applicable disbursements.
The Customer agrees that these collection costs are genuine anticipated expenses and not a penalty.
Special Buy-Ins
Products sourced or manufactured specifically for the Customer are non-returnable once the order has been placed. The Customer warrants that any logos, images, or materials supplied do not infringe third-party rights, and agrees to indemnify Academic Media against any related claims.
Clearance Products
No additional discounts apply to clearance products. These items are not returnable once ordered.
Customer-Specific Stock
Where Academic Media has sourced stock specifically on behalf of a Customer and the Customer does not take delivery within agreed or notified timeframes, Academic Media may, at its discretion:
• Charge a storage fee for holding the stock
• Invoice the Customer for all or part of the stock
• Arrange for disposal or use of the stock, with all associated costs payable by the Customer
Product Safety
Where required, our products have been evaluated by accredited third-party laboratories to meet applicable safety standards. Some items are classified as dangerous goods and cannot be shipped by airfreight; an MSDS is required for shipping these items. Contact us for testing information or compliance certificates.
Colours & Styles
We work closely with our suppliers to minimise colour variation between shipments; however, some variation is unavoidable due to manufacturing processes and dye lots. If colour or style accuracy is important to you, we recommend requesting a sample from the current stock shipment.
Product styles and colours may change slightly between production runs. Printing methods — including pad printing, screen printing, digital printing, sublimation, heat transfer, and laser engraving — are subject to variation over time and through normal use.
Product Scratches & Blemishes
Some products may carry minor scratches, scuff marks, or blemishes that occur naturally during manufacturing or transit. We aim to identify and individually bag affected items where possible.
Product Scratches & Blemishes
Some products may carry minor scratches, scuff marks, or blemishes that occur naturally during manufacturing or transit. We aim to identify and individually bag affected items where possible.
Pantone Colour Matching
When ordering screen or pad printed items, please supply coated Pantone colour references. While every effort is made to match colours as closely as possible, a 100% colour match cannot be guaranteed due to the nature of different materials and print processes.
Technology Compliance & Warranty
Our power banks and wall chargers comply with applicable Australian/New Zealand standards (look for the RCM mark). Products with USB ports or power supply carry a 12-month limited warranty from the date of purchase against manufacturer defects.
Items must be returned to Academic Media for assessment. Academic Media is not liable for damage resulting from unauthorised repair or misuse. If a returned item is found to be in working order or damaged through misuse, a return postage and handling fee may apply.
Confectionery Conditions
Confectionery is sourced from multiple manufacturers; bag sizes and styles may vary. Once confectionery has left our premises, it cannot be returned under any circumstances for health and safety reasons. We recommend storing confectionery in a fridge below 4°C in a cool, dry area. Flavours and colours may vary between shipments.
Stress Reliever Conditions
Stress relievers are not toys and are not suitable for children or animals. Due to the nature of polyurethane (PU) material, excessive force — particularly pulling on thin sections such as necks, arms, or legs — may cause tearing. This is not a product defect. Stress relievers are designed to be squeezed, not pulled, and are handmade, meaning minor variations in appearance and print consistency are inherent to the product.
Plush Conditions
Plush items are individually sewn and stuffed, and minor variations in size and shape between shipments are inherent to the manufacturing process. It is a condition of sale that customers accept these variations.
Brochure and Website Images & Content
Product images and descriptions on our website and in print materials are as accurate as we can make them. Images are used to demonstrate personalisation possibilities and do not imply endorsement by trademark owners. Colours displayed digitally may not accurately represent final product colours, and typographical errors may occur. We reserve the right to correct any errors without notice.
Printed Products
Colour variation during and between print runs is an inherent characteristic of CMYK printing. While we take every step to minimise variation, factors including paper stock, press conditions, and temperature can affect the final result. For the most consistent results, please specify your Pantone colour reference and ensure artwork is set up to the same CMYK breakdown. An exact colour match is not guaranteed.
Order Acceptance
Academic Media reserves the right to accept orders in whole or in part, or to decline or cancel an order at any time. Once an order has been accepted into Academic Media's system, it cannot be cancelled by the Customer.
Customer Authority
Where the Customer is a company, association, or trustee, Academic Media is not required to investigate the authority of the individuals placing or approving orders. Any credit extended in reliance on a professed exercise of authority will form part of the principal debt, even if later found to have been given without proper authorisation.
Inconsistencies
Orders are accepted on the basis of these Terms and Conditions unless otherwise agreed in writing by Academic Media. Where the Customer's order terms conflict with these Terms and Conditions, delivery of the product will constitute an offer by Academic Media to supply on these Terms and Conditions, which the Customer accepts by retaining or using the goods.
Jurisdiction
These Terms and Conditions are governed by the laws of New South Wales, Australia.
